These Terms of Service (“Terms”) govern your use of the Space Coast Camera website (the “Site”) and your relationship with Space Coast Camera (“Company,” “we,” “us,” “our”). By using our Site, requesting information, reserving rental gear, or purchasing products, you agree to these Terms.

1) Rentals, Sales, and Information

We provide camera gear rentals and may offer select products for sale. Product availability, pricing, and specifications may change at any time.

Any rental reservation, quote, or estimate may be based on information you provide and may change due to availability, condition checks, duration, add-ons, or other factors. Timelines and availability are estimates only and may be impacted by demand, shipping/carrier delays (if applicable), maintenance needs, weather, or other factors outside our control.

2) Reservations, Pickup/Return, and Customer Responsibilities

You agree to provide accurate contact details and follow any instructions related to reservation, pickup, return, and safe equipment handling.

You are responsible for:

-Providing a valid government-issued ID and payment method as required

-Inspecting equipment at pickup (or upon delivery) and notifying us promptly of issues

-Using equipment safely and lawfully, and only as intended

-Protecting equipment from theft, loss, liquid damage, sand/salt exposure, impact damage, misuse, or unauthorized modification

-Returning equipment on time and in the condition received (normal wear excepted)

3) Deposits, Payments, Holds, and Fees

Unless otherwise agreed in writing:

-Payment may be required to confirm a reservation.

-We may place a refundable security deposit or authorization hold on your payment method.

-Late returns may result in additional daily charges and/or replacement fees as permitted by law and consistent with the rental agreement.

-Non-payment may result in reservation cancellation, denial of pickup, or other actions permitted by law.

4) Cancellations and Rescheduling

Reservations may be rescheduled based on availability. Cancellation and refund eligibility may depend on timing and whether gear has been reserved/blocked for you.

If you cancel within a short window before your reservation start date, or fail to show for pickup, you may be charged a cancellation fee or for reserved time, as permitted by law and consistent with the rental agreement.

5) Loss, Damage, Theft, and Responsibility

You are responsible for loss, theft, or damage to rental equipment during the rental period (including while in transit, if applicable), except to the extent prohibited by law.

We may charge repair costs, cleaning fees, replacement costs, and/or loss-of-use fees (e.g., time the gear cannot be rented due to damage), consistent with the rental agreement.

6) Product Sales

If we offer products for sale, all sales are subject to availability. Unless otherwise stated in writing, sales may be final or subject to a limited return policy (if any). Certain items (e.g., used gear) may be sold “as is” with no warranty beyond what is expressly provided.

7) Warranties and Disclaimers

To the fullest extent permitted by law:

-The Site and services are provided “as is” and “as available.”

-We do not guarantee uninterrupted access to the Site or error-free operation.

-We do not guarantee specific outcomes from the use of rented or purchased equipment.

-Manufacturer warranties may apply to products and are controlled by the manufacturer.

8) Limitation of Liability

To the fullest extent permitted by law, Space Coast Camera will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability related to any claim will not exceed the amount paid to us for the specific transaction (rental or purchase) giving rise to the claim.

9) Communications Consent (Calls, Email, SMS) — A2P/TCPA

By providing your contact information (including your phone number), you agree that we may contact you for service-related purposes such as:

-Reservation confirmations and reminders

-Pickup/return coordination

-Support responses and status updates

-Billing, receipts, and account communications

-Message frequency varies. Message & data rates may apply.

Opt-out: You can opt out of text messages at any time by replying STOP.

Consent note: Your consent to receive text messages is not required to make a purchase, but certain service messages may be necessary to fulfill reservations you request.

Data use and third-party sharing:

We do not sell, rent, or share your personal information with third parties for their marketing or promotional purposes. We may share limited information with trusted service providers (such as phone/SMS providers, email providers, hosting, analytics, CRM/scheduling tools, and payment processors) solely to operate our business and deliver requested communications and services. These providers are required to protect your information and use it only for these purposes. Mobile information will not be shared with third parties for marketing or promotional purposes.

Description of SMS use cases:

If you opt in to receive SMS messages from Space Coast Camera, we may text you for reservation and rental communications (confirmations, reminders, pickup/return coordination, extensions, and availability updates), customer support and service updates (responses to inquiries and status updates related to rentals, purchases, classes, or services), and billing/account communications (receipts, payment or hold notifications, invoices, and account notices). If you separately opt in to marketing, we may also send occasional promotional messages such as special offers, announcements, and updates. Message frequency varies. Message and data rates may apply.
